HOW CAN ACCSOS HELP?

  • I provide a no obligation conversation to discuss your ACC issue.
  • After obtaining your Authority to Act (ATA) I seek your ACC file(s) and lodge review application(s) where applicable.
  • Once files are received I provide you with a file review summary. The fee for this is $240 plus GST.
  • You then have the choice of having me represent you at mediation or review proceedings. If so then I will provide a fee agreement which is often a contingency no win no fee arrangement.
  • Often by providing more information or specialist medical opinions I can convince ACC to change their decision in your favour.
  • If ACC do not chnage ther decision I gather supporting evidence, draft legal submissions and represent you at the review hearing.

HOW MUCH WILL IT COST?

Fees for ACC Reviews can often be on a contingency basis. If you lose I charge only what ACC are directed to pay me on your behalf i.e. no additional cost to you.

If you win I charge a success fee agreed with you beforehand.

Fees for appeals are case-dependent.

acc review - time limits apply, so don't delay

Legislation sets the process for disputing ACC decisions and generally requires lodging an application for review. This can be done at the same time as requesting a copy of your ACC claim files and secures a right to a review whilst pursuing mediation or other settlement options.

Important: from the date that ACC issues a decision you only have 3 months to file an application for review. Late review applications can only be accepted in limited circumstances.

Examples of Decisions Commonly Overturned at Review

Injury Cover Decisions

Cover for physical or mental injury injury is a requirement for any ACC entitlement. I can help when ACC decline or revoke cover.

GP’s often lodge ACC claims for minor ‘sprains’ that turn out to be something more significant. I can make sure the correct injury(s) are covered going forward.

Cover for complex claims include; Treatment Injury (medical mishap), criminal acts and work-related gradual process conditions. We can help when cover is declined.

Surgery & Treatment

ACC often declines surgery funding or treatment on the grounds of old-age, pre-existing or gradual process wear & tear conditions.

Decline of surgery funding often comes as a surprise to claimants, who usually have a covered injury and the support of their surgeons.

I can manage your surgery review and present the best medical evidence for reconsideration, review hearing, or appeal to the District Court if your review is unsuccessful.

Weekly Compensation

All ACC payments and decisions about amounts of weekly compensation can be challenged.

Earnings amounts, earner status and suspension of payments are common issues for claimants.

Issues around work capacity, occupational assessments and Vocational Independence can present complex issues.

Work Injury & ACC Levies

Problems can arise where an employee or employer disagree with ACC about a work injury.

How ACC classifies work injuries can impact claimant payments. Employer ACC levies or experience rating can also be affected.

Gradual Process Conditions

Gradual process (wear and tear) type conditions are often declined by ACC due to the exclusions & complex requirements in the ACC Act.

Jason Lister - lawyer

Jason’s career includes 25 years experience in surgery and anaesthesia as a UK trained Operating Department Practitioner working in public and private hospitals across most specialties including orthopaedics, neuro/spinal, transplants, plastics and major reconstructive surgery.

Moving to NZ in 2003, Jason continued clinical practice, whilst studying law. He was admitted as a Barrister and Solicitor in the High Court in 2017.

After qualifying as a lawyer Jason spent several years working within ACC as a Review Specialist, representing the corporation in review proceedings and mediation, handling more than 500 review cases.
